Reimbursement from the first day of sick leave for chronically ill employees
§56 Agreement
A §56 agreement allows employers to receive sick pay reimbursement from the first day of absence if the sick leave is due to a chronic or long-term illness. The municipality must approve the §56 agreement, and the employee must meet certain conditions. The illness must be chronic or long-term and, based on a medical assessment, is expected to result in at least 10 sick days per year. The §56 agreement is valid for up to two years but can be renewed.
The agreement cannot be used in cases of permanent reduced work capacity, where an employee has fixed "sick days" as part of their work schedule.
You must still report the employee’s sick leave as usual.
Initiating the §56 Agreement Application
As the employer, you are responsible for initiating the §56 agreement application. This is done using the DP 211 form: "Agreement between Employer and Employee on Reimbursement of Salary or Sick Pay During Illness."
The DP 211 form is available on Virk and can be completed via the self-service portal.
Once you have completed your part of the application, the employee will receive a letter with a link in their e-Boks. The employee must then fill out and finalize their section before the municipality processes the application.
